Whale of a Time

The birth of the Occupy movement stirs sleepy nations
Crying out for environmental, social and economic liberations
While the G20 summit is in the red zone to resolve the Eurozone -
Greece, Italy and Spain are zoned out in deprivation
While governments search for a deficit cure
Budgets are cut for society’s poor
While climate change in Durban struggles to find an ear
Farmers are struggling to keep crops alive amid droughts in fear
While the Occupy Movement is expanding to all lands
People are joining in global conversation to take matters in their own hands.

With the Occupy Agenda seeking referenda with some extra time
Ideas issued in the “Bank of Ideas” are paving the way for a new paradigm
The campaign against the injustices of the global financial system calls for “an end to tax havens and tax avoidance”
The small tax payer is looking for condolence
“More transparency over business lobbying”, no more space for bargaining!
Clear calls to prosecute executives, a legal reform, that should be the norm
Our fundamental message is that we are all affected. We’re all connected – Entangled in the web of life
Stand up for justice in our fight!
Occupy for Nature’s Right!

Join an expedition of high school students as they journey down the Baja California peninsula to the largest gray whale breeding and calving lagoon on our planet. Soul Migration is a film project of Finding the Good Traveling High School Semester Program. Students learn documentary film making and the power of story to reach and teach others about solutions to the world’s problems. Soul Migration tells the story of the California Gray Whale, and what humans can learn from the past in order to change the course of the future.

At Finding the Good, youth study and research working models of sustainability and then make media to educate others. They are on the edge of new awareness that takes us from thinking of Nature as property, to respecting Nature’s right to exist, thrive and evolve. The education is not simply about whales, or history, but about a turning point in our relationship to natural communities, and to each other. This journey will reshape their lives and the lives of all who hear their story. They will be creating curriculum materials about the Rights of Nature to distribute to schools.

Film Dedication

Soul Migration is dedicated to the memory of Carol Weisheimer Bearden, who always wanted to see the whales, and to Morgan Decker-Stone, whose eyes lit up like no other when he first encountered a friendly gray.

They are asking for our support in the production of the film. Learn more at Soul Migration Kickstarter.

We were very touched by the warm welcoming, Mr. Galdean offered us. We could feel immediately, his warm heart and the love he had for Mother Earth. Mr. Galdean was very happy to hear that the project of Rights of Mother Earth exists, and he offered his partnership on behalf of the ROMANIAN ECOLOGICAL UNIVERSITY towards raising 1 million signatures for the Earth Summit at Rio de Janeiro.

In June 2012. To start out with, we agreed to create workshops for students around the theme of RIGHTS OF MOTHER EARTH.

In October I went on my second Journey to the Rainforest of Ecuador with The Pachamama Alliance, lead by Robin Milam. Being with the Achuar People – who still live according to their ancient traditions in harmony with nature and are a stand for keeping the oil under the ground – was reaffirming that Rights of Nature’s time is over due. This time I also went to the North of Ecuador on a “Toxic Tour”, to see with my own eyes the devastating pollution left over from the oil exploitation that started in the 70′s and still going on.

An old Indian chief said, everything you do to the Earth, you do it yourself. The “climate change” relative to the choices about our role in Nature, should start from new forms of thought. The fathers of the new vision of nature and ecology have been writers like Henry David Thoreau and Walt Whitman, thinkers such as Aldo Leopold, John Muir, founder of the world’s first national park in the USA. An evolutionary line that led the lawyer Cormac Cullinan who coined the title of his book-manifesto Wild Law, by which the debate has moved even on legal grounds, the wild Laws are those designed to balance the rights and responsibilities of the human race in front of the other members of the community land: plants, animals, rivers, ecosystems, etc.

In 2010 came the Universal Declaration of the Rights of Mother Earth, away from an anthropocentric view, our century will be the recognition of the true hierarchy of the planet and the species will really blend in to provide vital resources for future generations. This is also part of a widespread non political movement and Author, and traveller Davide Sapienza (recently awarded of Pigna D’Argento 2011 prize as best emerging writer of the last decade for travel, nature, and adventure) after writing an essay titled The Future of Nature a while back (inspired by the Orion Magazine book of the same title), has invited a fellow writer and journalist to “use” 2011, the International Year of Forests, as a starting point to deliver a speech about The Rights of Nature.

In Italy, where environmental crimes provide only administrative penalties, in the last decade has increased exponentially in a quiet and moderate movement that is widely recognized “rights to nature,” despite the policy choices that go in the opposite direction, and the absence of overall shared vision.

DAVIDE SAPIENZA www.davidesapienza.net

Whatever he does to the web, he does to himself.”
Chief Seattle, 1854.

The following message was posted on our Value Nature as Living Being petition site:

Man did not create the Web of Life, he is just one strand in it. What we do to the Web, we do to ourselves. All things are related.

Man cannot create one blade of grass nor one drop of water; Our Mother Earth does these for us.

We do not rule this planet, we are subject to it; it would be intelligent to remember that. We must be stewards, we must control our numbers, we must not unbalance the very fine parameters that allow animal and plant life to survive on the only blue planet in our Universe.

Without the soil there will be no plants, without plants there will be no animals (that’s us). Without land we have nowhere to live for we cannot swim in sea water forever, nor drink it.

We are like a snake that eats its own tail…..sooner or later there will be no snake left! Earth has rights – sacred rights going back millennia.

Once we lived respecting the harsh realities of her rule and we were no threat to her sustainability. We have lost that respect, that intelligence, that wisdom. We have great knowledge but very little wisdom.

Just because you can do something doesn’t mean you should!

If Mankind has rights, (and we have given them to ourselves) then the Earth that sustains us and without which we would not exist, must also have the same and greater rights. Otherwise, we should have none either. Accept our place in the Web of Life or be cut from it.

In this dynamic seminar we will learn about the historic 2008 event when Ecuador became the first country to include Rights of Nature in its national constitution and then cover movements since then in Bolivia and here in the U.S. as Rights of Nature takes hold as an idea whose time has come. Rights of Nature laws create a right to legal standing, such that people, communities, Indigenous peoples, non-profit environmental organizations, and others would have standing to protect the environment. Climate activists have long been seeking a tool, which would enable communities affected by climate change to gain recognition for the harms done not just to human interests around the globe, but also to environmental ones. We come together with a common interest to actively advance the creation of human communities that respect the Rights of Nature. We will also explore how Rights of Nature invigorates momentum for a new cultural narrative that honors our living Earth. Join us and step into this historical moment!

This course will include:

What are Rights of Nature?

What is happening in the local/ global movement for Rights of Nature?

How can we change our cultural narrative to create an Earth-honoring society?

Justice for the Earth Community: Defending the Rights of Nature and holding Corporations to Account

Monday 26th September
6.30pm – 7.30pm food and wine at Gaia House
7.30pm – 9.30pm talk and Q&A at Burgh House, Hampstead.

Nnimmo will talk about the Rights of Nature and corporate responsibility campaigns in relation to cases in Ecuador and Nigeria.

In April 2010, the Deepwater Horizon disaster off the Gulf of Mexico saw over 4 million gallons of oil leak into the sea. It was the worst oil spill in American history and one of the worst spills the planet has ever seen. Hundreds of thousands of people lost their livelihoods and the devastation caused to marine life is unfathomable.

On 26th November last year, a coalition of environmental organisations and indigenous activists – led by Nnimmo Bassey and Vandana Shiva – filed a precedent setting case in the Constitutional Court of Ecuador against British Petroleum (BP). They accused BP of violating the Rights of Nature. The Ecuadorian Constitution was the first in the world to recognise the Rights of Nature (or ‘Pachamama’) and to state that humans have a legal obligation to ‘maintain and regenerate Earth’s vital cycles, structure, functions and its processes in evolution’.

He will also explore why this strategy is necessary and is part of a bigger shift required in society today. A shift that will require that laws and policies comply with the laws of the Earth, and a way of living which maintains the health and integrity of the whole Earth Community.

Nnimmo will also be sharing a small selection of poems from his new book “I will Not Dance to Your Beat”.

Cost: £12 full price, £8 concessions. Price includes wine and light buffet. Please Book online to reserve a place, or contact Rowan@gaianet.org.

More about Nnimmo

Nnimmo Bassey is a Nigerian environmental activist and poet, and head of Friends of the Earth International. In 2010 Nnimmo received of the Right Livelihood Award (alternative Nobel Peace Prize) and featured in Time Magazines ‘Heroes of the Environment’ in 2009.

I request to the powers that be, to understand that we are destroying our planet. That we must avoid everything that contaminates and might be a source of ecological damage, like nuclear reactors and weapons that people use against other people.

Many of my age (I´m 66 years old) have seen many disasters as the atomic bomb, Chernobyl, tsunamis, etc.

Alternative energies, such as wind, water and solar power should be used.

We are more than 7.000.000. millions inhabitants and many more to be … We are running short of water, food, etc. In many countries, included Argentina, desnutrition rates are unbarable.

We need to reduce greenhouse gas emissions, that affect the ozone layer.

Let´s remember that Mother Earth, as a living being, knows that we are attacking her and she knows how to defend herself. Just have a look at the natural disasters happenig around the world. No country will be able to avoid Apocalypses.

Not only animals and plants that are in extinction are going to disappear, but also human beings.

Therefore these is more than a petition, it is an order to change our habits.

I am thinking not only in myself, but in all my descendants and generations to come.

It scares me to think in the planet we are leaving them.”

Global Youth Assembly (GYA) in Edmonton, Canada on Thursday July 28, 2011. Young people ages 16 to 28 came from Edmonton, Rwanda, Ukraine, Bolivia, Nunavut, rural Alberta, and many other places and walks of life to share in the GYA experience.

Nati spoke about the legal protection Ecuador’s Constitution affords nature through itsRights of Nature articles. The St. Albert Gazette reported on Nati’s presentation at GYA. “Nature is like a plane,” she says, “and if we keep taking parts out of it, eventually it will crash.”

“We are a part of nature,” she says. “If we don’t respect nature, we’re not respecting our rights.”

In attempting to introduce the idea of Rights of Mother Earth to the United States, my concern would be it’s capitalists heritage/culture. To change U.S. approach to natural resource extractions (drilling) or other environmental exploitation, would demand a change in Earth’s designation as property to that of ‘legal entity’, having the same legal rights as corporations and people. As long as Earth’s surface is considered property to be exploited or destroyed, the thoughtless destruction of our resources and land will continue relatively unchecked.

It is vital that Earth be given legal entity rights comparable to the artificial juristic person designation enjoyed by corporations today. And while Earth is similar to humans because it is a living, breathing, growing and dying being – human life is of her – corporations are simply receptacles for people’s money. ”Entity” status would provide Earth equal protections under the law. Environmental contracts could carry the clause: Do no harm to the habitat that sustains us, or some such legally binding words. Organizations and states must be made to install the most up to-date and environmentally safe equipment. Any business, corporation, federal, state or county agency that destroys habitat, or pollutes rivers or well water or pollutes the air could be held legally accountable by those affected. Agricultural businesses that create new untested genetic products, will be held accountable for adverse effects to neighboring land. Any business, corporation, federal, state or county agency that promotes/sells toxic/untested material as safe and nurturing (bio-solids) will be held accountable (The White House grounds cannot host an organic garden because a previous resident approved the application of toxic bio-solids. I would hope that someone was held accountable for that travesty).

Sincerely and with great hope,

We invite all Nations to sign the Declaration of The Rights of Mother Earth at the Earth Summit 2012 in Rio de Janeiro and implement rights of nature in their national constitution.

We call on the General Assembly of the United Nations to adopt rights of nature as a common standard of achievement for all peoples and all nations of the world.

The following is why it is important to me that my country supports Rights of Nature:

Just for a moment I would invite you to close your eyes and imagine your life and the life of your family without this earth. This planet is our life. As we destroy the earth we destroy ourselves. As we ignore the rights of nature we ignore our own right to life. Please honor this truth and know the people of this country want to believe in your integrity to protect our planet. Please respect the voices of your people and set the example for the rest of the world. Lead this great country in adopting this Declaration of the The Rights of Mother Earth so that the rest of the world might follow your example and create in history an action that truly saves humankind.

Something so simple as the statement of the title of this letter, ‘Our Mother Earth Is Our Connection To Life’, deludes the so-called progressive human. When modern education turns its entire attention to the graded achievement of learning by rote Science and Math, History and Language, humanity has a product of a child who has no respect and no knowledge for Spirit and Art. Spirit and Art are the other side of Science and Math which creates a whole balanced outlook and anchors a young life with roots in reality. Instead we are producing people without souls and who have no connection to life.

Spirit and Art are matters which modern society deems ‘optional’ interests. Modern society is traveling a dangerous path, wallowing in its own technological refuse and creating disharmony in the world. Its people walk around without soul purpose unaware of other worlds, inconsiderate of their own world. Yes, its nice to have fresh food in a package that one can pick up from a store using a credit card, but what is the price we pay for being so disconnected to our Mother Earth. Most of our modern people don’t participate in the process of growing food, dipping our hands in the soil that grows our food, caring about the soil, the air, the plants and trees that survive with us. We don’t hunt an animal in the forest, honoring its life when we take it for our survival and sharing it with our tribe, village, town or family. We just don’t share, share our world with the creatures and plants that create our well being.

Let us take lessons from our ‘primitive’ brothers and sisters who share their world with Mother Earth, who survive without plastic bags, credit cards and cell phones. Let us watch them for ways back to Spirit and Art, back to the balance of life we once knew. And if we bring our technology into this world, we bring it with respect and understanding of the cycles of the Earth Mother. We bring it with her agreement and with her love. For without Mother Earth’s love, we are dust in the wind.

Mister President Giorgio Napolitano

As an Italian citizen, I consider adopting the Universal Declaration of The Rights of Mother Earth as a first and important step to acknowledge that Mother Earth really is the Body from which and inside which we all live and possibly prosper.

Italy, my country, has a peculiar problem with its relationship concerning the environment, Nature, Mother Earth and natural resources. As a writer and essayist, lecturer and Author I consider this so important that I only lecture about my book walking in Nature with the people who decide do share this view. In Mother Earth’s embrace, we feel the need that we as humans have to show the due respect and will to preserve her beauty, in which ultimately lays the key to understanding that by severing – as we did centuries ago – our relationship with her, our real and true Mother, we have started a road that is leading all to a ugly destination called DEATH.

Pollution and the relationship with Nature are NEVER included in any major party’s programme in the last decades, and I never hear of this issues while they should be a daily concern of all governments, and ours too. I hope Italy will adopt the Universal Declaration and will proceed by inserting in our National Constitution some articles in the fashion adopted in 2008 by the groundbreaking new Constitution of Ecuador.

With due respect

D S

In Italian

Egregio Presidente Giorgio Napolitano
